A member of Congress put the FDA on notice this week over its slow-walked review of the abortion pill, and the Pennsylvania Senate is back Monday.

Chip Roy presses FDA, and threatens a funding fight

On October 14, Rep. Chip Roy wrote to Acting FDA Commissioner Kyle Diamantas about the mifepristone review. Earlier this year he withdrew an amendment that would have cut off federal funds for the 2023 rule change allowing abortion pills by mail and through pharmacies. He says he did that based on the understanding that FDA would finish its review this fall. Now FDA expects to complete its evaluation in March 2027.

“The need to complete a review cannot become a justification for indefinite delay,” Roy wrote. He says that, absent prompt action by FDA, he’ll seek to put his amendment in the next continuing resolution to block taxpayer dollars from implementing the 2023 changes. He asked FDA to answer his questions by October 27. FDA hasn’t decided anything yet. You can read his letter here.

The abortion amendment is still in the Senate

HB 1957, the abortion amendment, passed the House 102 to 101 and is still sitting in the Senate State Government Committee. The Senate returns Monday, and there are no abortion bills on its calendar. The Senate is the backstop keeping this amendment off the ballot.
